These Standards of Conduct apply to any use of Axiom Connected’s COVI Application, Iungo Portal and any combined solution thereof, as applicable (collectively, the “Products”).
Axiom Connected does not allow use of the Products, or the registration of accounts in connection therewith, with the purpose of promoting or inciting harm toward others or the promotion of discriminatory, hateful, or harassing content. To this end, in addition to any rights and remedies available at law or at equity, Axiom Connected may terminate a customer’s account, or an account of any user, if a customer, its affiliates or each of their users or personnel, use the Application for the following purposes and/or distribute content that Axiom Connected determines, in its sole discretion, contains any of the following:
- Disruption. Interfere with or disrupt Axiom Connected products or services;
- Illegality. Content offering to sell illegal goods or services;
- Hateful Content. Any statement, image, photograph, advertisement, or other Content that in our sole judgment could be reasonably perceived to harm, threaten, promote the harassment of, promote the intimidation of, promote the abuse of, or promote discrimination against others based solely on race, ethnicity, national origin, sexual orientation, gender, gender identity, religious affiliation, age, disability, disease, or immigration status;
- Improper Disclosures. Transmit, access or communicate any data that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non- disclosure agreements);
- Misrepresenting Identification. Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
- Misrepresenting Other Information. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any data transmitted to other users;
- Objectionable Material. Transmit or communicate any data or content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable;
- Pornography/sexually explicit content. Share pornographic content, or share explicitly sexual content where a minor is involved;
- Personal Data of Users. Collect or store personal data in violation of applicable data protection laws;
- Proprietary Notices. Remove any proprietary notices from our products or services;
- Proprietary Rights. Transmit, access or communicate any data that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
- Security Measures. Take any steps to interfere with or in any manner compromise any security measures with respect to our products or services or any data or file transmitted, processed or stored on or through our products or services;
- Spoofing. Intentionally make available “spoofed” files or data, or files or data with any type of information designed to misidentify the actual content of a file or which is intended to mislead the recipient of the file;
- Stalking. Any act that constitutes the willful and repeated harassing of another person;
- Threat of Physical Harm. Any statement, photograph, advertisement, or other content that in our sole judgment could be reasonably perceived to threaten, advocate, or incite physical harm to or violence against others;
- Violation of Applicable Laws. Violate any applicable local, state, national or international law, including any rules and regulations of any securities exchange, any laws, rules or regulations applicable to bulk or commercial email, including the CAN-SPAM Act of 2003; or
- Viruses. Transmit or communicate any data that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
